Registration or licence? It depends how you're paid

The single biggest factor is your compensation model. Flat-fee and revenue-share are treated very differently — and getting the classification right saves months and real money:

Revenue share → full licenceIf you take a share of player revenue, licensing states require a full licence (New Jersey's ACSIE, Pennsylvania's certified GSP) — deeper background checks, disclosures and fees.
Flat-fee (CPA) → registrationIf you're paid a fixed fee per player, most licensing states let you register as a vendor / registered gaming service provider — lighter and faster, but flat-fee only.
No affiliate regime → foreign qualificationPlenty of states have no specific gaming-affiliate licence. There you operate legally by foreign-qualifying your entity — registering it to do business in that state — which we handle too.

Two examples

New Jersey

Flat-fee affiliates register as a vendor (free, but a casino partner initiates it). Revenue-share affiliates need an ACSIE licence — more disclosure and a $2,000 non-refundable application fee. Registration is with the DGE.

Pennsylvania

Affiliates are Gaming Service Providers: registered for flat-fee, certified for revenue-share (a deeper, costlier background investigation, including fingerprinting). Marketing materials must be pre-approved.

FAQ

Do gambling affiliates really need a licence in the US?

In regulated states, yes — to be paid for promoting licensed operators you must be registered or licensed. Flat-fee (CPA) models usually need a lighter registration; revenue-share models require a full licence (e.g. New Jersey's ACSIE or Pennsylvania's certified Gaming Service Provider).

What's the difference between registration and a licence?

Registration is lighter and faster but typically limits you to flat-fee deals. A full licence allows revenue-share but requires deeper background checks, financial disclosures, fees and — in some states — fingerprinting. We classify each state correctly for your model.

Is it one filing or many?

Many. There's no single federal gaming-affiliate licence — each regulated state (NJ, PA, MI, Ohio and others) has its own regime. We build a sequenced multi-state plan so you're licensed where the revenue is.

What about states with no affiliate licence?

Many states don't have a specific gaming-affiliate licensing regime. There you operate legally by foreign-qualifying your entity — registering it to do business in that state and appointing a registered agent. We handle that too, so you're covered across all 50 states, not just the licensing ones.
