Brazil Gambling Licence Application: Closed Since 25 September 2026
Brazil stopped taking gambling licence applications on 25 Sep 2026. Under MP 1,394, pending SPA requests fall away. What applicants should do now.

There is no longer an application process for a Brazilian gambling licence. Medida Provisória nº 1,394, published on 25 September 2026 and in force from that day, bans fixed-odds betting in Brazil and bars new authorisations. This page used to walk through the SPA application stage by stage; it now covers what the measure means for anyone who was applying or planning to.

If your application was pending
Article 6 says requests for concessions, permissions and authorisations not yet decided on the date of publication “ficarão prejudicados”, meaning they are disposed of without a decision. There is no transition for pending applicants and the measure says nothing about refunding costs incurred in preparing a file. If you had an application with the SPA, it is over while the measure stands. Keep your documents; if the law changes again, much of the corporate and compliance work may be reusable, but there is no basis today to assume it will be.
If you were about to apply
Stop spending on the Brazilian file. The company, local shareholding, capital and certification work the old process demanded no longer leads anywhere. If you already set up a Brazilian company for the application, talk to local counsel about what to do with it; the measure does not address that.
If you already hold an authorisation
You are in a wind-down with fixed deadlines: sites and apps offline ten days after publication, refunds funded two days after that, and the authorisation extinguished 30 days after publication with no refund of the grant fee. What happens in Congress
A provisional measure is law from publication, but under article 62 of the Constitution it loses effect from the start unless Congress converts it within 60 days, extendable once by another 60. Congress lists 25 September to 23 November 2026 as the first deliberation period, with amendments taken until 1 October. The outcome is open. We will update our Brazil guide when it is known.

Can I apply for a gambling licence in Brazil?

What happens to an SPA application that was already filed?
If the SPA had not decided it by 25 September 2026, it falls away (art. 6, sole paragraph). The measure provides no refund mechanism or transition for pending applicants.
Should I keep preparing a Brazilian application in case the ban is reversed?
That is a commercial call. The measure lapses unless Congress converts it into law within 60 days, extendable once by 60 (Constitution, art. 62), but Congress could also convert or amend it. Nothing can be filed while it is in force.
